Terms of Service

These Terms of Service (hereinafter referred to as “Agreement”) set forth the conditions under which Japan Trails (hereinafter referred to as “the Company”) provides travel-related services (hereinafter referred to as “the Service”) to users (hereinafter referred to as “the Customer” or “you”).

By accessing or using the Service, you agree to be bound by this Agreement.

Article 1 (Service Overview)

The Company provides personalized travel experiences in Japan, including walking tours, cultural activities, food tours, and custom itineraries for foreign visitors. The Service allows customers to browse, inquire, and book local tours operated or mediated by Japan Trails.
The Company may collaborate with third-party providers (hereinafter “Tour Partners”) for some activities. In such cases, the final agreement may be concluded directly between the Customer and the Tour Partner.

Article 2 (Application of the Agreement)

This Agreement governs all use of the Service. In case of separate terms, guidelines, or policies provided for individual services, they shall also apply alongside this Agreement. In the event of conflict, this Agreement shall prevail unless otherwise specified.

Article 3 (Service Use Purpose)

The Service is intended for personal, non-commercial use. Any commercial use or resale of the Service without the Company’s prior written consent is prohibited.

Article 4 (User Requirements and Environment)

Customers are responsible for securing their own internet connection and compatible devices to access the Service. Any required software, communication fees, or equipment shall be at the customer’s own expense.

Article 5 (Registration and Accounts)

To book tours or use certain features, Customers may be required to register and provide accurate, up-to-date information.
The Company reserves the right to approve or deny registration at its sole discretion and may cancel a registration without notice if any of the following apply:

  • False or incomplete information was provided
  • The applicant is underage and lacks guardian consent
  • The applicant has a history of violating Company policies
  • The applicant is connected to antisocial forces
  • Other cases deemed inappropriate by the Company

Article 6 (Account Management)

Registered users are responsible for safeguarding their user ID and password. Sharing, transferring, or selling account credentials is strictly prohibited. The Company is not liable for any damages caused by unauthorized access due to poor password management.

Article 7 (Booking, Payment, and Cancellation)

  • All tours must be booked in advance.
  • Fees are clearly indicated at the time of booking and must be paid via the accepted methods.
  • Cancellation policies are specified during booking and may vary depending on the tour. Refunds may be partially or fully denied based on the timing of cancellation.
  • If a tour is canceled due to weather, safety, or operator availability, a full refund will be provided.

ArtArticle 8 (Tour Content and Disclaimers)

The Company provides tour experiences through its own guides and occasionally through third-party providers. While every effort is made to ensure accuracy and quality, the Company makes no guarantees regarding the completeness, correctness, or reliability of the information provided.

The Company shall not be liable for any of the following:

  • Injuries, losses, damages, accidents, delays, or irregularities during participation in the tour
  • Sudden changes in the itinerary due to weather, natural disasters, government restrictions, strikes, or unforeseen events
  • Service interruptions or cancellations caused by transportation issues, public safety concerns, or operational decisions
  • Theft, loss, or damage to personal belongings during the tour
  • Language misunderstandings, cultural differences, or behavior by other guests that may cause discomfort

All activities are conducted at the participant’s own risk.
Customers are strongly advised to obtain travel insurance covering medical expenses, cancellations, and personal liability.

If the Customer books a tour that involves third-party providers (e.g., restaurants, cultural venues), any disputes or claims arising from those services must be resolved directly with the provider. The Company assumes no responsibility for services rendered outside of its control.

Article 9 (User Content: Photos, Videos, and Reviews)

By submitting, uploading, or sharing any content (including but not limited to photos, videos, written reviews, and testimonials) via the Service or related channels such as social media, the Customer agrees to the following:

  1. License Grant
    The Customer grants the Company a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, display, and otherwise exploit the submitted content for promotional, marketing, or operational purposes, without further notice or compensation.
  2. Content Ownership and Responsibility
    The Customer affirms that they own the rights to all submitted content or have secured all necessary permissions and licenses for third-party material contained within.
    The Customer further agrees not to upload or share content that:
    • Infringes any copyright, trademark, or other intellectual property
    • Violates privacy rights or includes identifiable images of individuals without consent
    • Contains obscene, offensive, or unlawful imagery or statements
    • Misrepresents the Company or the Service in a false or defamatory way
  3. Editing and Publication
    The Company may edit, crop, resize, or summarize user-submitted content for clarity or format. Content may be published on the Company’s website, social media, advertising materials, and media partnerships.
    Submitted content may be attributed using the Customer’s display name or initials unless anonymity is requested in writing.
  4. No Liability for Public Use
    The Company shall not be liable for any claims, losses, or damages arising from the use of submitted content, whether by the Company or third parties acting with the Company’s permission.

Article 10 (Prohibited Actions)

Users are strictly prohibited from:

  • Violating laws or this Agreement
  • Posting abusive, discriminatory, or false content
  • Causing disruption to services or harming others
  • Collecting personal data from other users
  • Promoting external businesses or spam
  • Impersonating the Company or its guides

Article 11 (Service Suspension or Termination)

The Company may suspend or discontinue the Service without notice in the event of:

  • System maintenance or failures
  • Natural disasters or emergencies
  • Legal obligations or other operational decisions

The Company is not liable for any resulting damages.

Article 12 (Account Termination by User)

Registered users may terminate their account at any time by contacting the Company. Outstanding payments must be settled prior to withdrawal.

Article 13 (Changes to Service or Agreement)

The Company may modify or discontinue the Service or this Agreement at any time. Continued use of the Service after changes indicates your acceptance of the updated terms.

Article 14 (Privacy Policy)

The Company handles personal data in accordance with its Privacy Policy. By using the Service, you consent to the collection and use of your data.

Article 15 (Governing Law and Jurisdiction)

This Agreement is governed by the laws of Japan. Any disputes shall be subject to the exclusive jurisdiction of the Tokyo District Court.

Article 16 (Language)

This Agreement is drafted in English for reference. In case of conflict with a Japanese version, the Japanese text shall prevail.
